Parmazip Terms of Use

1. About Parmazip Platform and Services

Parmazip Inc. ("Parmazip", "we", "us") owns and operates an IT platform that includes applications, websites, content, products, and services (collectively, the "Parmazip Platform"). The Parmazip Platform allows registered users ("Users", "you", "your") to access telepharmacy services offered by licensed pharmacy professionals in Ontario, Canada (collectively, "Authorized Providers") and various other health-related services. Telepharmacy involves healthcare delivered via interactive text, audio, and/or video technology, where the patient and healthcare provider are not in the same location (services provided through the Parmazip Platform are collectively called "Telepharmacy Services" in these Terms). The Parmazip Platform also allows Users to store personal and health information ("PHI"), share this PHI with Authorized Providers, and electronically receive and store prescriptions, sick notes, and other documents. Additionally, Parmazip offers optional services at a User's request and may periodically introduce more optional services. Parmazip operates in accordance with the laws of Ontario, Canada.

2. Acceptance of Terms

Parmazip is a telepharmacy service that connects users with licensed pharmacists for minor ailment consultations and prescribing. By downloading, accessing, or using the Parmazip Platform, you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use Parmazip.

3. Eligibility

To be eligible to use the Parmazip Platform, you must:

  • be at least 18 years old and warrant that you meet this age requirement
  • be a temporary or permanent resident of a province or territory of Canada
  • Create a Parmazip account.

If you are assisting someone with accessibility needs (such as a person with a disability), you may access and use the platform as an authorized representative, provided you have their consent and act in their best interest.

4. User Accounts

To access certain features of Parmazip, you may be required to create an account. You agree to:

  • the collection, use, disclosure, and storage of health information through Parmazip;
  • Provide accurate, current, and complete information;
  • Maintain and promptly update your information;
  • Keep your password secure and confidential; and
  • Notify us immediately of any unauthorized use of your account.

You may terminate your account at any time for any reason by deleting your account through the User Settings page in the application and by sending us an email to securely delete the account from the database.

5. Scope of Telepharmacy Services

Authorized Providers and Their Relationship with Users: Only regulated pharmacy professionals are permitted to offer Telepharmacy Services. These professionals can be either Authorized Pharmacists or Authorized Pharmacy Business Owners. "Authorized Pharmacists" are pharmacists licensed to practice pharmacy in at least one Canadian province or territory. "Authorized Pharmacy Business Owners" are business administrators of a pharmacy, who are registered and licensed to practice in a Canadian province or territory.

Telehealth Licensing Requirements: Each Canadian province and territory has specific regulations governing who can practice telehealth and under what conditions. Depending on your location, Authorized Providers might not reside in your province or territory while delivering Telepharmacy Services. We indicate the jurisdiction of Authorized Providers during consultations, and this information is available on our website. For further details, consult the relevant regulatory body (often referred to as the "College," such as the "College of Pharmacists") of which the Authorized Provider is a member. Most health profession regulators in Canada have an accessible register of their members on their website.

Not a Replacement for Primary Care: Telepharmacy Services do not replace appointments with your regular primary care provider. If you do not have a primary care provider, we encourage you to find one. Parmazip does not send reports of the Telepharmacy Services you receive to your primary care provider. We strongly recommend informing your primary care provider about any Telepharmacy Services you receive, including any medications prescribed.

Health Data Sharing Among Providers, Your Primary Care Provider, and Your Preferred Pharmacy. Your Primary Care Provider or Preferred Pharmacy might ask for details about the findings from the Authorized Provider. To help you with this, the Parmazip Platform provides you with a summary of your Telepharmacy Services through the application, which you can send to your Primary Care Provider and/or Preferred Pharmacy. Alternatively, with your consent, your Authorized Provider may fax the consultation summary to your Primary Care Provider and/or Preferred Pharmacy through the application.

6. Telepharmacy Services Terms of Use

As a User of Parmazip Telepharmacy Services, YOU UNDERSTAND AND AGREE TO THE FOLLOWING:

  1. The Parmazip Platform is a web application that connects Users with Authorized Providers for Telepharmacy Services. Although Parmazip enables access to Telepharmacy Services from these providers, it is not itself registered to offer Telepharmacy Services and does not provide them, as detailed below.
  2. Authorized Providers are independent contractors who use the Parmazip Platform to offer Telepharmacy Services. They are not employees of Parmazip nor do they act on Parmazip's behalf when providing these services. The relationship between you and the Authorized Provider is strictly a health professional-patient relationship, in which Parmazip is not involved.
  3. Parmazip provides the following services:
    • A directory of available licensed pharmacists and pharmacy businesses for minor ailment consultations;
    • Telepharmacy consultations for minor ailments with licensed pharmacists;
    • Medical record management such as prescriptions and care plan notes;
    • Appointment reminders and information; and
    • Billing and payments for virtual consultations.
  4. AUTHORIZED PROVIDERS ARE FULLY RESPONSIBLE FOR THE TELEPHARMACY SERVICES THEY PROVIDE TO YOU. THIS INCLUDES ADHERING TO STANDARDS OF VIRTUAL CARE, MAINTAINING RECORDS, FULFILLING OTHER PROFESSIONAL DUTIES, AND COMPLYING WITH PRIVACY LAWS.
  5. Because virtual care regulations vary and may change over time among different provinces and territories, the availability of Telepharmacy Services will depend on both your province or territory of residence and your location at the time you request the services.
  6. Like any minor ailment consultation, there are no guaranteed outcomes associated with Telepharmacy Services. Your Authorized Provider may decide that Telepharmacy Services are not suitable for some or all of your treatment needs, or that they are not permitted to provide the specific services you require, and therefore may choose not to proceed with the Telepharmacy Services. Authorized Providers also have the discretion to stop providing Telepharmacy Services to you at any time and for any reason.
  7. You are responsible for furnishing the Authorized Provider with the information deemed necessary for them to deliver Telepharmacy Services to you. If you choose not to provide this information, the Authorized Provider may be unable or unwilling to proceed with providing you Telepharmacy Services.
  8. As with any other virtual care service, there are risks associated with the use of the Telepharmacy Services. In addition to any risks communicated to you by your Authorized Provider, there are risks unique to telehealth, which include that the Parmazip Platform may not permit the transmission of information in a way that allows the Authorized Provider to provide Telepharmacy Services (for example, due to poor resolution of images). Other risks of the use of electronic means to transmit and store information are described in Parmazip's Privacy Policy.
  9. Authorized Providers are prohibited from prescribing certain types of medication, such as narcotics, controlled substances, and other drugs with potential for abuse, unless they have an established ongoing treatment relationship with you.
  10. Any prescriptions obtained from an Authorized Provider are intended solely for the personal use of the individual named on the prescription.
  11. All prescriptions processed through Parmazip are subject to verification by a licensed pharmacist. Parmazip does not endorse or recommend any specific medication, pharmacy, or pharmacist.
  12. It is important to thoroughly read all provided product information and labels, and to consult a physician or pharmacist if there are any questions regarding the prescription or medication.
  13. Drug reactions, side effects, or adverse events should not be reported through the Parmazip Platform. Instead, report any medication reactions, side effects, or adverse events to your primary care provider. If you do not have a primary care provider, contact the nearest walk-in clinic or emergency room. In case of emergency, dial 911.
  14. You should seek emergency assistance or follow-up care as advised by an Authorized Provider.
  15. THE PARMAZIP PLATFORM IS NOT INTENDED FOR EMERGENCY HEALTHCARE. IF YOU BELIEVE YOU ARE EXPERIENCING AN EMERGENCY, PLEASE CALL 911 IMMEDIATELY OR GO TO YOUR NEAREST EMERGENCY ROOM.

7. Virtual Care Policy

By submitting a virtual consultation request through Parmazip, you confirm your informed consent to participate in a Minor Illness Assessment appointment involving you and a pharmacy professional from your chosen pharmacy.

  • You attest that the information provided is accurate to the best of your knowledge.
  • You acknowledge the secure exchange of information and liability between you, the pharmacy, the pharmacy professional, Parmazip, and any other healthcare professionals involved in this consultation in accordance with accepted medication therapy management principles;
  • You understand that Parmazip is a tool for pharmacists to conduct minor ailment consultations. Parmazip is not liable for any recommendations given by the pharmacy professional, who is solely responsible for all diagnoses, treatment plans, and medical-related activities.
  • You also understand that the pharmacy and pharmacy professional may use the details that you provide in the consultation to process information, including procedures, pricing or reimbursements, eligibility, and follow-ups.
  • Additionally, you recognize the inherent privacy and security risks associated with virtual care, if applicable, and the best practices implemented by you and the pharmacy to mitigate these risks.

8. Data Privacy & Security

Parmazip is designed with data privacy as a fundamental principle, adhering to the highest standards for health data privacy, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and Personal Health Information Protection Act (PHIPA).

Your use of Parmazip is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information. By using Parmazip, you consent to our collection and use of your data as described in the Privacy Policy.

9. User Conduct

As a User of Parmazip Telepharmacy Services, you agree not to:

  • Use Parmazip for any unlawful purpose;
  • Misrepresent your identity or affiliation;
  • Violate any applicable laws or regulations; and
  • Engage in any activity that interferes with or disrupts Parmazip and its services.

10. Fees and Payment Options

As a User of Parmazip Telepharmacy Services, YOU UNDERSTAND AND AGREE TO THE FOLLOWING:

  1. You will be charged a transaction fee for the Telepharmacy Services received from an Authorized Provider ("Provider Fee") and a service fee for your use of the Parmazip Platform ("Service Fee," collectively referred to as the "Fees"), unless these Fees are paid by a third party payer (such as your employer or insurer) that has an agreement with Parmazip.
  2. Similar to other health professional services, when Telepharmacy Services are not covered or insured by your provincial or territorial health plan ("Health Plan"), these services require a fee (referred to as "Uninsured Telepharmacy Services"). The Provider Fees you are charged for Telepharmacy Services apply only to Uninsured Telepharmacy Services.
  3. If your Health Plan covers the Healthcare Services and you meet the eligibility criteria, you are not required to pay for these services (referred to as "Insured Telepharmacy Services").
  4. You may have to pay the fees for Uninsured Telepharmacy Services at the time you request healthcare services. Parmazip may require you to submit credit card information before the provision of any Uninsured Telepharmacy Services for the purpose of validation of the card. You will not be able to begin accessing the services through the Parmazip platform if the credit card information you provide is inaccurate and/or if your credit card is declined at the point of validation. You agree that Parmazip, on behalf of Authorized Providers, may validate your credit card and put a hold on it in the amount of the Fees. Parmazip will notify you of any applicable fees, inclusive of applicable taxes, and will only have the charge processed to your credit card after obtaining the corresponding Uninsured Telepharmacy Services. Parmazip will provide you with a receipt for the Fees you pay.
  5. Parmazip facilitates payment of Provider Fees from you directly to Authorized Providers. Payment of the Provider Fees through the credit card validation and processing arrangement described above will be considered the same as payment made directly to the Authorized Provider.
  6. You will pay all applicable fees and such fees may be amended from time to time. We encourage you to contact us if you have questions about Provider Fees charged for Healthcare Services.
  7. All Fees for Uninsured Telepharmacy Services are in Canadian dollars. Service fees are inclusive of any applicable taxes based on your billing location.
  8. If you have any questions about the Parmazip Platform Fees, we encourage you to contact us.

11. Appointment Booking, Rescheduling, Cancellations, and Refunds

As a User of Parmazip Telepharmacy Services, YOU UNDERSTAND AND AGREE TO THE FOLLOWING:

Booking

  • Patients may book an appointment at least 30 minutes before the appointment time.
  • When you book an appointment, Parmazip will place a hold on your payment method for the full consultation fee. This is not an immediate charge, but a temporary authorization to ensure the funds are available.
  • You will only be charged after the appointment is completed, or if a late cancellation or no-show fee applies.

Rescheduling

  • Rescheduling must be requested at least 4 hours before the appointment time.
  • Requests made less than 4 hours in advance will be treated as a late cancellation.

Cancellations

  • Cancellations are free of charge if made 4 hours or more before the appointment.
  • Late cancellations (within 4 hours) will incur a cancellation fee of $10.
  • No-shows will be charged the full consultation fee (unless due to a documented emergency).

Refunds

  • Refunds (minus any applicable fees) will be processed within 24 hours.
  • No refund will be provided for no-shows or late cancellations unless an exception is granted.

Exceptions

We understand that emergencies happen. Fee waivers can be requested in cases of:

  • Medical emergencies
  • Unexpected hospitalizations
  • Power/internet outages (with supporting evidence)
  • Other unforeseen events evaluated on a case-by-case basis

Pharmacist Policy

Pharmacists may reschedule consultations with at least 4 hours' notice to the patient.

In case of an unavoidable last-minute cancellation, Parmazip will:

  • Notify the patient immediately
  • Offer a priority rescheduling option at no extra cost
  • Provide a full refund if rescheduling is not acceptable

Communication Channels

All cancellations or rescheduling must be submitted via Parmazip App or Web Portal, Customer Support Chat, or email at support@parmazip.ca.

Fair Use & Abuse Prevention

Repeated abuse (e.g., 3+ no-shows or late cancellations within 2 months) may result in temporary suspension of booking privileges or requirement to pre-pay for future consultations.

12. Intellectual Property

All content, trademarks, and other intellectual property on Parmazip are owned by Parmazip or its licensors. You may not use, reproduce, or distribute any content from Parmazip without our prior written permission.

13. Disclaimers

Parmazip provides Parmazip on an "as-is" basis without any warranties of any kind, either express or implied. We do not warrant that Parmazip will be uninterrupted or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, Parmazip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Parmazip.

15. Indemnification

You agree to indemnify, defend, and hold harmless Parmazip, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of Parmazip.

16. Modifications to Terms

Parmazip reserves the right to modify these Terms at any time. We post the current version of the Parmazip Terms at https://parmazip.ca/terms. Depending on the nature of the changes, we will post the latest version of these Terms through the Parmazip website (https://parmazip.ca) with the effective date and/or notify you of any changes. Your continued use of Parmazip after such changes constitutes your acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
